Bitou municipal manager’s illegal re-appointment finally confirmed by the Labour Appeal Court

By Cathy Labuschagne – Constituency Head: After fighting Advocate Lonwabo Ngoqo’s illegal re-appointment as Municipal Manager in Bitou since March 2019, the Democratic Alliance (DA) in Bitou finally triumphed this morning when Labour Appeal Court Judges Davis JA, Coppin JA and Kathree-Setiloane AJA dismissed the municipality and Ngoqo’s appeal with costs.

This judgement follows the 13 August 2019 Labour High Court judgement that found Ngoqo’s reappointment on 25 March 2019 illegal.

The DA calls on the executive mayor and his ANC coalition partners who voted in favour of Ngoqo’s appointment, well knowing that the appointment would be illegal, to pay the cost order out of their own pockets rather than from the municipal coffers.

The DA believes that this could be a watershed judgement that can facilitate the dismantling of the corruption network that was systematically constructed in Bitou municipality after the 2016 LGE.
