{"id":2484,"date":"2013-05-31T14:03:04","date_gmt":"2013-05-31T12:03:04","guid":{"rendered":"http:\/\/thegremlin.co.za\/oudtshoorn-news\/wordpress\/?p=2484"},"modified":"2013-05-31T14:03:04","modified_gmt":"2013-05-31T12:03:04","slug":"municipalitys-response-to-cshell-vs-oudtshoorn-municipality-judgement","status":"publish","type":"post","link":"http:\/\/thegremlin.co.za\/oudtshoorn-news\/wordpress\/2013\/05\/31\/municipalitys-response-to-cshell-vs-oudtshoorn-municipality-judgement\/","title":{"rendered":"Municipality\u2019s Response to CShell vs Oudtshoorn Municipality Judgement"},"content":{"rendered":"<p>OUDTSHOORN \u2013 The Council welcomes the Judgement of the Supreme Court of Appeal on Friday, in the matter between CShell 271 (Pty) Ltd and the Oudtshoorn Municipality, dismissing the CShell appeal with costs.<\/p>\n<p><img decoding=\"async\" class=\"aligncenter size-large wp-image-2490\" alt=\"1\" src=\"http:\/\/thegremlin.co.za\/oudtshoorn-news\/wordpress\/wp-content\/uploads\/2013\/05\/14-440x330.jpg\" width=\"440\" height=\"330\" srcset=\"http:\/\/thegremlin.co.za\/oudtshoorn-news\/wordpress\/wp-content\/uploads\/2013\/05\/14-440x330.jpg 440w, http:\/\/thegremlin.co.za\/oudtshoorn-news\/wordpress\/wp-content\/uploads\/2013\/05\/14-220x165.jpg 220w, http:\/\/thegremlin.co.za\/oudtshoorn-news\/wordpress\/wp-content\/uploads\/2013\/05\/14.jpg 800w\" sizes=\"(max-width: 440px) 100vw, 440px\" \/><\/p>\n<p>This Judgement upholds the earlier ruling of the Western Cape High Court, albeit on different grounds.<\/p>\n<p>The dispute arose when the Oudtshoorn Municipality awarded a tender to develop Erf 5366 to Newco, a company to be incorporated and with a specified black empowerment constituent profile of natural persons, and was later replaced by the appellant, CShell 271 (Pty) Ltd, who sought to enforce the tender.<\/p>\n<p>The percentage shareholding of CShell was belatedly revealed after some 2 \u00bd years and did not meet the Broad Based Black Economic Empowerment (BBBEE) criteria.<\/p>\n<p>The SCA found that \u201cCShell quite clearly did not possess locus standi to seek a review of the municipality\u2019s decision to cancel \u2018the award\u2019 of the tender&#8230; as CShell acquired no rights in the contract concluded as a result of the award of the tender.\u201d<br \/>\nThe Municipality cancelled the tender on the grounds of the CShell BBBEE percentage profile, but Acting Judge of Appeal KGB Swain found that CShell\u2019s lack of standing made it unnecessary to decide whether this BBBEE related municipal decision should have been made an order by the Western Cape High Court.<\/p>\n<p>\u201cThe Council has in the recent past been castigated for unnecessary law suits and this Judgement confirms that decisions to go to court are not taken lightly and are made after due application of minds and in the interests of tax payers and residents,\u201d concluded the Aldm Gordon April, the Executive Mayor in his response to the judgement.<\/p>\n<div style=\"padding-bottom:20px; padding-top:10px;\" class=\"hupso-share-buttons\"><!-- Hupso Share Buttons - https:\/\/www.hupso.com\/share\/ --><a class=\"hupso_toolbar\" href=\"https:\/\/www.hupso.com\/share\/\"><img decoding=\"async\" src=\"http:\/\/static.hupso.com\/share\/buttons\/share.png\" style=\"border:0px; padding-top: 5px; float:left;\" alt=\"Share Button\"\/><\/a><script type=\"text\/javascript\">var hupso_services_t=new Array(\"Twitter\",\"Facebook\",\"Google Plus\",\"Linkedin\");var hupso_background_t=\"#EAF4FF\";var hupso_border_t=\"#66CCFF\";var hupso_toolbar_size_t=\"big\";var hupso_image_folder_url = \"\";var hupso_url_t=\"\";var hupso_title_t=\"Municipality%E2%80%99s%20Response%20to%20CShell%20vs%20Oudtshoorn%20Municipality%20Judgement\";<\/script><script type=\"text\/javascript\" src=\"http:\/\/static.hupso.com\/share\/js\/share_toolbar.js\"><\/script><!-- Hupso Share Buttons --><\/div>","protected":false},"excerpt":{"rendered":"<p>OUDTSHOORN \u2013 The Council welcomes the Judgement of the Supreme Court of Appeal on Friday, in the matter between CShell 271 (Pty) Ltd and the Oudtshoorn Municipality, dismissing the CShell appeal with costs.
