Amnesty Campaign on Building Plans

George Municipality has launched an amnesty campaign to allow landowners to legalise all existing illegal construction works on their property without paying the appropriate higher building plan fees and to update building plans records.

The Council has extended the current amnesty period for general building plans for a further period of 6 months to 31 December 2017. General building plans applications for Indigent households as well as applicants in the rural areas as well as in Uniondale, Haarlem and surrounding areas have been given a further extension for a period of 6 months, from 1 January 2018 to 30 June 2018.

Aggressive information campaigns have been launched to raise awareness of owners’ responsibilities and landowners are encouraged to legalise any unlawful structures on their plots.

Mr. Nico Koen, the Manager: Building Control says the information campaigns have made many landowners aware of their responsibilities. The building control department is overwhelmed with inquiries regarding the status of landowners’ building plans in the council’s possession. Existing illegal structures that qualify for amnesty are submitted daily. The amnesty campaign is a great success and many landowners are in the process of legalising all illegal structures and/or illegal land use. The building control department is experiencing a noticeable increase in the amount of building plans submitted.

Since July 1, 2015 to September 6, 2017, 882 amnesty building plans have been submitted.

Koen says, however, he believes that despite campaigns, media reports, radio broadcasts, advertisements, notifications and much more, many landowners still fail to legalise illegal structures and/or illegal land uses.

In terms of Section 4 (1) of the National Building Regulations and Building Standards Act, No. 103 of 1977 and other applicable legislation, it is the responsibility of the Local Authorities to ensure that no one has a building, either temporary or permanent, and regardless of the materials which is used for its erection, without the prior written approval of the local government concerned.

Landowners are called upon to act within the said Act. Koen says there will be strict action after the amnesty campaign. Landowners who do not obey the law make themselves guilty of an  offense.

The Council approved the appointment of a draftsman on a fixed-term contract of 12 months to assist in the preparation of building plans in all residential areas that qualify for Indigent on the municipality’s database.

Amnestie-veldtog rakende Bouplanne

 

George Munisipaliteit het ‘n amnestie-veldtog begin om grondeienaars die geleentheid te bied om alle bestaande onwettige  bouwerke op hul eiendom te wettig , sonder om die toepaslike hoër bouplangelde te betaal en ten einde bouplanrekords op datum te bring.

Die Raad het goedgunstiglik die huidige amnestie periode vir algemene bouplanne  vir ‘n verdere tydperk van 6 maande tot en met 31 Desember 2017 verleng. Algemene bouplanaansoeke vir Deernis-huishoudings asook     aansoekers in die landelike gebiede asook in Uniondale, Haarlem en omliggende gebiede is vir ‘n verdere tydperk van 6 maande verleng, vanaf 1 Januarie 2018 tot en met 30 Junie 2018.

Daar is agressiewe inligtingsveldtogte geloods om die gemeenskap bewus te maak van hul verantwoordelikhede en grondeienaars is aangemoedig om hul enige onwettighede te wettig.

Mnr. Nico Koen, die Bestuurder: Boubeheer sê die inligtingsveldtogte het baie grondeienaars bewus gemaak van hul verantwoordelikhede. Die boubeheerafdeling word oorval met navrae rakende die status van hul bouplanne wat in die Raad se besit is. Bestaande onwettige strukture wat kwalifiseer vir amnestie word daagliks ingedien. Die amnestie veldtog is ‘n groot sukses en baie grondeienaars is in die proses om alle onwettige strukture te wettig en/of is alreeds gewettig. Die boubeheerafdeling ondervind ‘n merkbare toename aan die hoeveelheid bouplanne wat ingedien word.

Sedert 1 Julie 2015 tot en met 6 September 2017 amnestie tydperk is 882 amnestie bouplanne ingedien.

Koen sê is egter van mening dat ten spyte van veldtogte, mediaberigte, radio- uitsendings, advertensies, kennisgewings en meer, baie grondeienaars steeds versuim om hul onwettige strukture en/of onwettige grondgebruike te laat wettig.

Kragtens Artikel 4(1) van die Wet op Nasionale Bouregulasies en Boustandaarde, No 103 van 1977 en ander toepaslike wetgewing is dit die Plaaslike Owerheid se veranwoordelikheid om toe te sien dat niemand ‘n gebou, hetsy tydelik of permanent van aard en ongeag die materiale wat by die oprigting daarvan gebruik word, sonder die voorafgaande skriftelike goedkeuring van die betrokke plaaslike regering oprig nie.

Daar word ‘n beroep op grondeienaars gedoen om binne vermelde Wet op te tree. Koen sê daar sal streng opgetree word na afloop van die amnestie-veldtog. Grondeienaars wat nie gehoor gee aan die wet nie, maak hulself skuldig aan ‘n misdryf.

Die Raad het goedkeuring verleen vir die aanstel van ‘n tekenaar op ‘n vaste termyn kontrak van 12 maande om behulpsaam te wees met die opstel van bouplanne in alle woongebiede wat op die Munisipaliteit se databasis    kwalifiseer vir deernis.

Grondeienaars kan die boubestuur-afdeling  besoek indien hulle enige navrae het oor strukture of bouplanne by die George Munisipale hoofgebou, Vierde Vloer, Yorkstraat of bel 044 801 9370.
